We are Biocheck B.V. We respect your privacy and personal life, but sometimes we need personal data from you. In this statement you can read what data we use and how we store, protect and process this data. This privacy policy applies to our website www.biocheck.nl (the Website), our online application (the App) and the services we offer (the Services). We treat your personal data in accordance with the General Data Protection Regulation (the Relevant Legislation).

Under 16 years of age

If you are under 16 years of age, you will need permission from your parents or legal guardian to use our Website, App and Services.

Personal data

We may hold your data at various times, such as when you visit our Website, create an account on the Website, use our App, use our Services or when you contact us. We may process your data because we comply with Relevant Legislation. Indeed, we only use your data if we need it to perform our agreement, if we need it to comply with a legal obligation, if we have a legitimate interest and/or if you have given us your consent. If you choose not to share your data, we will not be able to provide some of our Services to you.

Basis

We are Biocheck B.V. We respect your privacy and personal life, but sometimes we need personal data from you. This statement tells you what data we use and how we store, protect and process that data. This privacy policy applies to our website www.biocheck.nl (the Website), our online application (the App) and the services we offer (the Services). We treat your personal data in accordance with the General Data Protection Regulation (the Relevant Legislation).

What data do we collect and what do we do with it?

Personal account
We store this data mentioned below under your personal account. You can view this data at any time, and change it if necessary, when you log into your personal account.

We process the following data to be able to execute the agreement with you, to fulfil our legal (administrative) duty and/or because you have voluntarily chosen to share the information. You can stop the voluntary information sharing at any time. This data includes:
– your name;
– your address and place of residence;
– your e-mail address;
– your telephone number;
– a photograph in which you are recognisable (optional);
– address and contact details of your employer
– payment details.

We also store your IP address, but this is not visible to you. The following data are processed by us because this data is necessary to support the analysis of your performance being measured. The basis for this processing is the performance of the agreement with you and/or because you have voluntarily chosen to share the information. You can stop the voluntary information sharing at any time.
These are the data:
– your age;
– your date of birth;
– your gender;
– your location (optional);
– your profession;
– other data you provide, in correspondence and/or by telephone (optional).

The following special data are processed by us because they are necessary for the analysis of your performance and to determine your recovery capacity. This data is used to analyse how you function at rest and under stress and what your maximum capacities are. Based on these analyses, we map out the correct application of the Powered by Biocheck method for you to promote your recovery. The bases for this processing are the performance of the agreement with you and your consent. You can withdraw your consent for this at any time. It will then no longer be possible to use our App and our Services.

These are the data:
– the measurements of your heart coherence;
– your heart rate measurements;
– the measurements of your breathing.

Furthermore, the results of the measurements are processed into graphs about your ability to recover. These graphs are stored under your personal account. This allows you to view your progress. With your permission, these graphs can be viewed by yourself, us and your company doctor.

With your permission, we anonymise measurement results for statistical research. The anonymised results can be used in statistics on general fitness levels and cost savings. With your permission, your employer may view these anonymised statistics.

Finally, you can save your password and username under your personal account. This way, you do not have to enter these data again. This data is not visible and only known to you.

Non-personal information
We also collect information from you that is not personal when you use our Website or App, such as:
– the name of the browser you use;
– the operating system you use;
– on which platform you access our Website.

Market research
We may ask you to participate in a market survey. We will then use your data for the market research. We use this statistical data anonymously for BioCheck B.V. You can close the questionnaire at any time. Your answers will not be given to third parties and will never be made public. In addition, the answers are not linked to your e-mail address.

Newsletter
We offer newsletters. This keeps you informed of offers, (discount) promotions, information about our programme, e-learning, changes to our programme and other news. To ensure your consent, we use the opt-in system for newsletters. An unsubscribe option is included in every communication along these lines.

Visitor information
We may ask persons visiting our sites and locations to register (name, identification and business contact details) and we may use camera surveillance, both for the protection and safety of persons and property and in connection with legal requirements.

Security

We make every effort to protect your personal data against loss, destruction, use, modification or dissemination of your personal data by unauthorised persons. This ensures that those who have nothing to do with your data cannot access it. We do this through the following measures:
– encryption (encoding) of digital files containing personal data;
– security of network connections with Secure Socket Layer (SSL) or similar technology;

– 24/7 Rapid Detection & Response Service
– employee confidentiality agreements;
– back-ups of the data

Retention periods

We will not retain your personal data for longer than 2 years after the expiry of your programme. After that, these data are automatically deleted. It is therefore not possible to recover, retrieve or use this data at a later date.

With whom do we share your data?

Processors
Sometimes other parties receive your data from us. We agree with these parties in a processor agreement that they will handle your data with care and they will only receive the data necessary to provide their service. These parties only use your data in accordance with the instructions we provide and not for their own purposes. For example, we may transfer your data to online storage services. They will take care of storing the data. These parties are “processors” within the meaning of the Relevant Legislation.

Third parties
Sometimes we share your data with other parties who are not processors. We agree with these parties that they will treat your data with care. They will only use the data in accordance with the purpose for which we obtained the data from you. Examples include the company doctor and the employer to whom, as explained above, the described information is shared only with your consent.

Transfer

We will only process your data within the European Union if you work and live within the European Union. Without your consent, we will never transfer your data to other countries or parties than those mentioned above.

The data we collect from you is personal. You therefore have the following rights:

– You may ask us for a copy of your data. We can also transfer this copy – at your request – to another party so that you do not have to do this yourself;
